Permission Forms

Ontario Law provides that there shall be no interment without the consent of the owner of the burial rights. If the original owner has died without transferring the remaining plots to individuals, the correct interpretation of “owner” is all those who have an interest in the burial rights. The Lakefield Cemetery will accept authorization for interment using the following forms, depending on the need. It is the executor’s responsibility to assure that authorization is obtained from all those entitled before the burial can take place.

Permission for Interment

Permission for Interment

This form may be used by the current living Interment Rights Holder(s) registered at the Lakefield Cemetery or after the death of the registered Interment Rights Holder(s) by their legal heir(s) or authorized representative(s). This form allocated permission for interment and memorialization only and does not transfer Interment Rights.

This form can be complete as a pre-authorization and placed on file with the cemetery indicating who can be interred and or memorialized in a grave or lot in the future, as well as at the time of need to give permission for an interment or memorialization to take place forewith. The executor can complete this document on behalf of the deceased for a period of 3 years from the date of death of the Interment Rights Holder(s). After the 3 year period all surviving children and or grandchildren following the Succession Law Reform Act, 1990, will be required.

This document once filed with the cemetery will be used to allow those named to be interred and or memorialized. Permissions are not required to be utilized and can be removed by filing written notice with the Cemetery Office. The fee to file permission for interment can be found in the Cemetery Price List. All permissions and any associated fees must be paid before any interment can take place or any memorial can be altered or erected.

Transfer of Interment Rights

Endorsement of Sale or Transfer of Rights

This form is to be used by either the current living Interment Rights Holder(s) registered at the Lakefield Cemetery or after their death, by their legal heir(s) or authorized representative(s). This form transfers the Interment Rights from the Interment Rights Holder of record with the Cemetery to the person named on this document. The executor can complete this document on behalf of the deceased for a period of 3 years from the date of death of the Interment Rights Holder(s). After the 3 year period all surviving children or grandchildren following the Succession Law Reform Act, 1990, will be required.

This document once filed with the Cemetery will allow the new Interment Rights Holder(s) to direct future interments and memorialization on the grave, lot or niche. The fee to transfer the Interment Rights can be found in the Cemetery Price List.
